These Terms and Conditions govern professional planning services and travel arrangements provided by Empty Nester Getaways.
By paying a professional planning fee, approving a proposal, authorizing a payment, submitting traveler information, or booking travel through Empty Nester Getaways, you confirm that you have reviewed and accepted these Terms and Conditions.
The person making the payment or reservation confirms that they are at least 18 years old and authorized to accept these terms for themselves.
The person acting as the primary traveler or group contact is responsible for sharing all applicable information, supplier terms, payment deadlines, and travel requirements with the other travelers included in the reservation.
ABOUT EMPTY NESTER GETAWAYS
Empty Nester Getaways provides professional travel planning and booking services through its relationship with WorldVia Travel Network.
WorldVia Travel Network is registered with the State of Florida as a Seller of Travel.
Florida Seller of Travel Registration Number: ST36257
Empty Nester Getaways may act as an independent travel advisor and intermediary between travelers and independent travel suppliers.
Travel suppliers may include airlines, cruise lines, hotels, resorts, tour operators, transportation providers, insurance companies, excursion operators, rail companies, rental car companies, and other travel service providers.
PROFESSIONAL PLANNING SERVICES
Empty Nester Getaways charges professional fees for certain planning, research, booking, coordination, and administrative services.
The client-specific TravelJoy invoice will describe:
The trip being planned
The travelers or households covered
The planning service selected
The professional fee
The services included
The services excluded
The number of options included
The number of revision rounds included
Airfare status
Dining and activity status
Possible additional fees
Scope-change rules
Professional planning begins after the applicable planning fee has been paid.
Planning fees compensate Empty Nester Getaways for professional services. They are separate from supplier deposits, airfare, insurance premiums, taxes, travel costs, penalties, and other payments.
Planning fees are not automatically credited toward the cost of travel.
Payment of a planning fee does not guarantee:
A particular price
A particular supplier
Availability
Upgrades
Savings
Approval of special requests
A successful reservation
A particular travel outcome
PLANNING FEE ACCEPTANCE
Payment of a TravelJoy planning fee invoice authorizes Empty Nester Getaways to begin the services described in that invoice.
By submitting payment, the client confirms that they have reviewed and accepted:
The stated planning scope
The services included
The services excluded
The option limits
The revision limits
The additional-fee provisions
The scope-change rules
These Terms and Conditions
The paid invoice and the version of these Terms and Conditions presented during checkout form the agreement for the planning engagement.
PLANNING FEE REFUNDS
Planning fees pay for professional time, expertise, research, and administrative work.
A planning fee becomes earned as Empty Nester Getaways performs the agreed services.
Once professional planning work has begun, the fee is generally nonrefundable.
A refund may be considered when:
A duplicate payment was processed
An incorrect amount was charged
The client cancels before professional work begins
Empty Nester Getaways cannot provide the agreed service
Applicable law requires a refund
Any approved refund will be limited to the portion of the fee that has not been earned through work already completed.
A client’s decision not to travel, not to book, or to book independently does not create an automatic right to a planning fee refund.
OPTIONS AND REVISIONS
The number of options and revision rounds included will be stated in the planning fee invoice.
An option may be:
A cruise sailing
A resort
A tour package
A hotel
A room or cabin category
A transportation choice
A selected itinerary component
Unless specifically stated, the planning fee does not include several complete custom itineraries.
One revision round means one consolidated list of requested changes submitted at one time.
Scattered emails or messages may be grouped and treated as one revision round.
A revision changes part of the accepted trip direction.
A redesign changes the primary direction or structure of the trip.
A redesign may include:
Changing destinations
Changing countries
Changing from a cruise to a land trip
Changing the travel season
Changing the travel dates substantially
Changing the trip length substantially
Changing the primary budget substantially
Adding several destinations
Replacing most of the proposed itinerary
Starting over after rejecting the accepted trip direction
A redesign is not an included revision.
An additional fee or new planning quote may be required before redesign work begins.
CHANGES IN PLANNING SCOPE
Changes to any of the following may increase the planning fee:
Destination
Travel dates
Trip length
Budget
Number of travelers
Number of households
Departure airports
Travel style
Number of accommodations
Number of travel components
Airfare needs
Dining needs
Activity and attraction needs
Transportation needs
Accessibility needs
Pre-trip or post-trip arrangements
Empty Nester Getaways will explain any additional planning fee before beginning work outside the accepted scope.
ADDITIONAL PROFESSIONAL FEES
Additional fees may apply for services outside the accepted planning scope.
These may include:
Airfare research and ticketing
Additional destinations
Additional households
Additional itinerary options
Additional revision rounds
Major redesigns
Restaurant reservations
Timed attraction tickets
Detailed free-time planning
Complex private transfers
Complex rental car planning
Complex rail or ferry planning
Custom pre-trip or post-trip extensions
Rush planning
Special occasion coordination
Extensive accessibility research
Separate arrangements for individual group members
Post-booking changes
Cancellation administration
Any applicable fee will be disclosed before the additional work begins whenever reasonably possible.
SUPPLIER RELATIONSHIPS
Travel suppliers are independent businesses.
Empty Nester Getaways does not own, manage, operate, or control the suppliers providing travel services.
Each supplier has its own terms concerning:
Pricing
Deposits
Payments
Changes
Cancellations
Refunds
Credits
Baggage
Check-in
Travel documents
Health requirements
Conduct
Accessibility
Force majeure
Other services
The traveler agrees to the applicable supplier terms when approving or purchasing a travel service.
Supplier terms may be more restrictive than these agency terms.
Empty Nester Getaways is not responsible for a supplier’s acts, omissions, errors, negligence, bankruptcy, insolvency, schedule changes, cancellations, service failures, or failure to provide a requested accommodation.
PRICES AND AVAILABILITY
Quotes reflect information available when the quote is prepared.
Travel prices and availability can change at any time before a reservation is confirmed.
A proposal does not hold space unless the supplier has specifically confirmed a courtesy hold.
A reservation is not confirmed until:
The supplier accepts the booking
Required traveler information has been provided
The required payment has been processed
A supplier confirmation has been issued
Promotions may change, expire, or become unavailable without notice.
Empty Nester Getaways cannot guarantee that a prior quote, promotion, room, cabin, seat, tour, or fare will remain available.
CLIENT RESPONSIBILITY FOR REVIEW
Travelers must review all invoices, proposals, confirmations, tickets, and travel documents promptly.
The client must verify:
Traveler names
Name spelling
Birth dates
Travel dates
Departure and arrival cities
Airports
Flights
Hotels
Room or cabin categories
Cruise sailings
Tours
Transfers
Payment amounts
Payment deadlines
Passport information
Other reservation details
Traveler names must match the identification or passport that will be used for travel.
The client must report an error as soon as it is discovered.
Corrections may require cancellation, rebooking, fare differences, supplier penalties, or agency service fees.
Empty Nester Getaways is not responsible for costs caused by incorrect information supplied by the client or an error the client failed to report after receiving documents for review.
PAYMENTS
Supplier deposits and payments are governed by the supplier’s rules.
Payment deadlines shown on invoices and confirmations must be followed.
A reservation may be canceled by the supplier if payment is not received by the required deadline.
Empty Nester Getaways may send payment reminders as a courtesy but does not guarantee that every reminder will be sent or received.
The traveler remains responsible for knowing and meeting all payment deadlines.
Unless a recurring or automatic payment authorization has been established, future payments will not be processed automatically.
A failed, declined, disputed, or reversed payment may result in loss of the reservation or supplier-imposed penalties.
CREDIT AND DEBIT CARD AUTHORIZATION
The client authorizes the use of the payment method submitted for the amounts and services identified in the applicable invoice or payment authorization.
Travel payments may appear on the card statement under the name of:
A travel supplier
WorldVia Travel Network
A payment processor
Another disclosed travel entity
The client is responsible for ensuring that sufficient credit or funds are available.
The client must contact Empty Nester Getaways promptly if a charge appears incorrect.
Nothing in these terms prevents a traveler from exercising rights provided by applicable law or card-network rules.
A chargeback should not be used to avoid valid supplier cancellation terms, professional fees, or other charges that the client knowingly authorized.
If a client initiates a chargeback for an authorized and properly documented transaction, Empty Nester Getaways, WorldVia Travel Network, and the applicable supplier may provide the invoice, authorization, accepted terms, communications, and reservation records to the payment processor or financial institution.
TRAVEL INSURANCE
Empty Nester Getaways strongly recommends that travelers consider purchasing travel insurance.
Insurance may provide benefits for certain covered events, depending on the policy selected.
Possible benefits may include:
Trip cancellation
Trip interruption
Travel delay
Baggage loss or delay
Emergency medical treatment
Emergency evacuation
Supplier default
Other covered events
Coverage varies by policy, traveler, state of residence, trip cost, purchase date, and reason for the claim.
Insurance does not cover every situation.
Certain benefits may require purchase within a limited period after the first trip payment.
The traveler is responsible for reviewing:
Coverage
Exclusions
Limitations
Pre-existing condition requirements
Purchase deadlines
Claim requirements
The traveler should direct coverage and claim questions to the insurance provider.
Empty Nester Getaways does not decide insurance claims and cannot guarantee that a claim will be approved.
If the traveler declines insurance, the traveler accepts responsibility for losses that could otherwise have been eligible for coverage.
CANCELLATIONS
All cancellation requests must be submitted in writing.
A cancellation is not complete until it has been received, reviewed, and processed by Empty Nester Getaways and the applicable suppliers.
The date a supplier receives or processes the cancellation may determine the applicable penalty.
Supplier cancellation rules control refunds, credits, and penalties for supplier travel arrangements.
Some payments may be partially refundable, nonrefundable, or available only as a future travel credit.
The traveler remains responsible for:
Supplier cancellation penalties
Nonrefundable deposits
Nonrefundable airfare
Insurance premiums
Agency professional fees
Other applicable costs
Empty Nester Getaways may charge a cancellation administration fee when cancellation requires professional work.
The applicable fee will be stated in the planning scope, invoice, fee policy, or cancellation notice.
A cancellation administration fee is separate from supplier penalties.
Cancellation work may include:
Supplier communication
Cancellation processing
Refund tracking
Insurance documentation guidance
Reservation record updates
Client communication
Commission tracking
A planning fee is not automatically refunded when the related trip is canceled.
REFUNDS AND TRAVEL CREDITS
Suppliers control refunds and travel credits for supplier-provided services.
Empty Nester Getaways cannot issue a supplier refund before the supplier authorizes and releases the funds.
Refund timing depends on the supplier, payment processor, bank, and original method of payment.
Processing can take weeks or longer.
Future travel credits may include:
Expiration dates
Rebooking deadlines
Traveler-name restrictions
Destination restrictions
Fare differences
Blackout dates
Other supplier conditions
Empty Nester Getaways does not guarantee the value, availability, or usability of a supplier credit.
CHANGES TO BOOKED ARRANGEMENTS
Voluntary changes are subject to current availability, pricing, fare rules, and supplier approval.
A requested change may result in:
A higher price
Loss of a promotion
Supplier change fees
Cancellation penalties
Fare differences
New deposits
Agency professional service fees
Some reservations cannot be changed.
A new booking may be required.
Post-booking service fees may apply to voluntary changes, including changes to:
Hotels
Cruises
Tours
Vacation packages
Air tickets
Transfers
Other reservations
Minor corrections that do not require repricing or supplier changes may be handled without an additional agency fee.
SUPPLIER CHANGES AND CANCELLATIONS
Suppliers may change:
Schedules
Routes
Ships
Aircraft
Hotels
Room assignments
Cabins
Tour inclusions
Ports
Excursions
Transportation
Other services
These decisions are outside Empty Nester Getaways’ control.
When a supplier changes or cancels a service, the supplier’s rules determine the available alternatives, credits, or refunds.
Empty Nester Getaways will provide reasonable assistance with supplier changes.
An additional professional fee may apply when a disruption requires substantial itinerary rebuilding or new services outside the original planning scope.
AIR TRAVEL
Airline tickets are governed by airline fare rules.
Many fares are nonrefundable or restricted.
The traveler is responsible for reviewing:
Traveler names
Dates
Airports
Flight times
Connections
Baggage rules
Seat assignments
Entry requirements
Ticket restrictions
Airlines may change schedules, flight numbers, aircraft, routes, or seat assignments.
Airlines may also delay or cancel flights.
Empty Nester Getaways does not control airline operations.
Seat assignments and special requests are not guaranteed, even when they appear on a confirmation.
The traveler should check the flight status directly with the airline before travel and again on the day of departure.
The traveler is responsible for arriving at the airport within the time required by the airline and airport.
Missed flights, denied boarding, and resulting expenses are subject to airline rules and the traveler’s insurance coverage.
Airline baggage, seat, priority boarding, and other optional charges are generally separate unless specifically included.
AIRFARE SERVICE FEES
Airfare research, ticketing, and change services may require a professional service fee.
The client-specific invoice will state whether airfare is:
Included
Guidance only
Excluded
To be booked independently
Available later for an additional fee
Airfare service does not include:
Guaranteed seat assignments
Guaranteed upgrades
Points or miles bookings
Monitoring every future fare change
Refunds outside airline rules
Responsibility for airline operations
PASSPORTS, VISAS, AND ENTRY REQUIREMENTS
Each traveler is responsible for obtaining and carrying the correct travel documents.
These may include:
Passport
Visa
Electronic travel authorization
Driver’s license
REAL ID-compliant identification
Birth certificate
Parental consent documentation
Vaccination records
Health forms
Other documents
Requirements depend on the traveler’s citizenship, residence, age, destination, itinerary, transit points, and method of travel.
Passport validity and blank-page requirements vary by destination.
A passport card is not valid for all international travel.
Travelers should verify current requirements through official government sources and the applicable embassies or consulates.
Empty Nester Getaways may provide general information but does not provide legal or immigration advice.
Empty Nester Getaways is not responsible for denied boarding, denied entry, detention, deportation, or additional expenses caused by missing, expired, damaged, incorrect, or insufficient documents.
TRAVELING WITH MINORS
Travelers under age 18 may require additional documentation.
This may include a notarized consent letter from a non-traveling parent or legal guardian.
Requirements vary by destination, supplier, family circumstances, and custody arrangement.
Parents and guardians are responsible for confirming and carrying the required documents.
CRIMINAL HISTORY AND LEGAL RESTRICTIONS
Certain criminal convictions, pending charges, court orders, unpaid obligations, custody matters, or other legal issues may affect a traveler’s ability to leave the United States, enter another country, or use certain transportation.
Travelers are responsible for obtaining legal advice and verifying their eligibility to travel.
Empty Nester Getaways does not provide legal advice and is not responsible for denied boarding or entry related to a traveler’s legal circumstances.
HEALTH REQUIREMENTS
Travel may involve health risks and destination-specific health requirements.
These may include:
Vaccinations
Testing
Health declarations
Medication restrictions
Quarantine rules
Insurance requirements
Other measures
Requirements may change.
Travelers are responsible for reviewing current official health information and complying with destination and supplier rules.
Empty Nester Getaways does not provide medical advice.
Travelers should consult a qualified medical professional concerning health conditions, medications, vaccinations, and fitness to travel.
ACCESSIBILITY AND SPECIAL NEEDS
Travelers must disclose mobility, accessibility, medical, dietary, and other important needs before booking.
Empty Nester Getaways will communicate disclosed requests to applicable suppliers and assist within the accepted planning scope.
Suppliers control the facilities, transportation, equipment, rooms, services, and accommodations they provide.
A request is not guaranteed unless the supplier confirms it.
Some destinations, ships, hotels, tours, and transportation services may not meet the accessibility standards a traveler expects.
Complex accessibility research or coordination may require an additional professional fee when it falls outside the accepted planning scope.
The traveler is responsible for determining whether the trip is suitable for their physical condition and needs.
MEDICATIONS AND MEDICAL EQUIPMENT
Travelers are responsible for confirming the rules for transporting and using medications, controlled substances, oxygen, mobility equipment, refrigerated medicine, and other medical items.
Medication that is legal in one location may be restricted in another.
Travelers should carry required prescriptions, documentation, and medical information.
Empty Nester Getaways does not provide medical or pharmaceutical advice.
TRAVELER CONDUCT
Travelers must follow the rules of suppliers, destinations, transportation providers, and local authorities.
A supplier may remove or refuse service to a traveler whose conduct is unsafe, disruptive, abusive, illegal, or inconsistent with supplier policies.
Empty Nester Getaways is not responsible for refunds, additional expenses, or losses resulting from a traveler’s conduct.
Travelers are responsible for damage they cause to accommodations, vehicles, ships, equipment, or other property.
ALCOHOL, DRUGS, AND ILLEGAL ACTIVITY
Travelers are responsible for following all applicable laws and supplier rules concerning alcohol, drugs, controlled substances, weapons, and other restricted items.
Products or conduct permitted in one jurisdiction may be illegal in another.
Empty Nester Getaways is not responsible for arrest, detention, denied boarding, denied entry, confiscation, fines, or other consequences resulting from unlawful conduct or prohibited items.
DESTINATION RISKS
Travel involves risks.
These may include:
Illness
Injury
Crime
Political instability
Weather
Natural disasters
Transportation accidents
Labor disputes
Terrorism
Civil unrest
Disease outbreaks
Infrastructure limitations
Other hazards
Travelers are responsible for reviewing official government travel information and deciding whether they are comfortable traveling.
Empty Nester Getaways does not guarantee the safety or condition of any destination.
FORCE MAJEURE
Empty Nester Getaways is not responsible for delay, interruption, cancellation, loss, or additional expense caused by events beyond its reasonable control.
These events may include:
Severe weather
Natural disasters
Fire
Flood
Earthquake
Hurricane
War
Terrorism
Civil unrest
Government action
Border closure
Labor dispute
Strike
Disease outbreak
Epidemic
Pandemic
Quarantine
Transportation failure
Utility failure
Supplier insolvency
Other unexpected events
Supplier terms determine whether refunds, credits, changes, or alternatives are available.
Planning fees and agency service fees remain subject to the terms under which they were charged.
EMERGENCY ASSISTANCE DURING TRAVEL
Travelers should first contact the supplier responsible for the affected service.
This may include:
Airline
Hotel
Cruise line
Tour operator
Transportation provider
Travel insurance assistance company
Empty Nester Getaways provides reasonable emergency assistance when normal supplier assistance is unavailable or has not resolved an urgent travel problem.
Empty Nester Getaways is not a 24-hour emergency response service.
Immediate availability cannot be guaranteed.
Medical, safety, law enforcement, and life-threatening emergencies must be handled through local emergency services and the traveler’s insurance provider.
Non-emergency requests will be handled during normal business hours.
Emergency assistance does not include unlimited itinerary rebuilding or new booking work outside the accepted scope.
CLIENT COMMUNICATION
The client is responsible for providing accurate contact information and monitoring the email address and phone number supplied to Empty Nester Getaways.
The client should notify Empty Nester Getaways of changes to:
Email address
Phone number
Mailing address
Traveler information
Payment information
Travel needs
Empty Nester Getaways is not responsible when important information is not received because of:
Incorrect contact information
Spam filtering
Blocked messages
Full voicemail
Failure to monitor communications
ELECTRONIC COMMUNICATIONS AND RECORDS
The client agrees that planning documents, invoices, payment authorizations, confirmations, disclosures, and other records may be provided electronically.
Electronic payment, approval, or acceptance may be used to show agreement with the applicable terms.
The client should retain copies of invoices, terms, confirmations, insurance documents, and travel records.
Clients who require paper documents should make that request before payment or booking.
PRIVACY AND PERSONAL INFORMATION
Empty Nester Getaways may collect traveler information needed to plan and book travel.
This may include:
Full legal name
Birth date
Contact information
Passport information
Known accessibility needs
Dietary requests
Payment information
Other reservation details
This information may be shared with WorldVia Travel Network, TravelJoy, payment processors, travel suppliers, insurance providers, and other parties as reasonably necessary to provide the requested services.
Travelers should not send sensitive personal or payment information through unsecured communication methods when a secure form is available.
LIMITATION OF AGENCY RESPONSIBILITY
Empty Nester Getaways is responsible for performing its agreed professional planning and booking services with reasonable care.
Empty Nester Getaways is not responsible for the independent actions, failures, or negligence of travel suppliers or other third parties.
To the extent permitted by law, Empty Nester Getaways is not liable for indirect, incidental, special, consequential, or punitive damages arising from supplier services, destination conditions, travel disruptions, or events outside the agency’s reasonable control.
Nothing in these Terms and Conditions limits rights or remedies that cannot legally be limited.
DISPUTES AND CONCERNS
The client should notify Empty Nester Getaways promptly of any concern.
This allows the agency a reasonable opportunity to review the issue and seek a solution.
The client should provide:
A description of the concern
Relevant dates
Supplier information
Receipts
Photographs
Communications
Other supporting documents
Supplier complaints may also need to be submitted directly to the supplier within the supplier’s required time limit.
GOVERNING LAW
These Terms and Conditions are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
Unless applicable law requires otherwise, any legal proceeding concerning services provided directly by Empty Nester Getaways shall be brought in a court with proper jurisdiction in Lee County, Florida.
Supplier disputes may be governed by the supplier’s own terms, including a different governing law, venue, arbitration requirement, or claim procedure.
SEVERABILITY
If any part of these Terms and Conditions is found invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
NO WAIVER
A decision by Empty Nester Getaways not to enforce a provision on one occasion does not waive the right to enforce it later.
CHANGES TO THESE TERMS
Empty Nester Getaways may revise these Terms and Conditions for future transactions.
The terms presented with the applicable invoice, payment, or booking will govern that transaction.
A later website update will not automatically replace the terms already accepted for an existing paid planning engagement or confirmed reservation.
COMPLETE AGREEMENT
